Terms of Use

These Terms of Use (“Terms”) govern your use of the Marten application (“Marten”, “the app”, “we”, “us”), provided by KodeFoundry. By creating an account or using Marten, you agree to these Terms. If you do not agree, do not use the app.

1. License

We grant you a personal, non-exclusive, non-transferable, revocable license to use Marten on devices you own or control, subject to these Terms and the Apple App Store Terms of Service, which also apply.

2. Your account

To sync your notes you create an account using email and password, Sign in with Apple, or Sign in with Google. You are responsible for keeping your credentials secure and for activity under your account. You may delete your account at any time from within the app (Account menu → Delete Account); this permanently removes your account and all notes stored in the cloud.

3. Your content

You retain all rights to the notes, lists, credentials, and other content you create in Marten (“Your Content”). We do not claim ownership of Your Content. You are solely responsible for Your Content and for keeping your own backups.

4. Storing secrets

Marten lets you store sensitive items such as API keys, passwords, and account credentials, and to lock notes behind device biometrics. You store such information at your own risk. While we take reasonable measures to protect data in transit and at rest through our service providers, no method of storage is perfectly secure, and Marten is not a substitute for a dedicated, audited password manager for high-value secrets.

5. Acceptable use

You agree not to misuse Marten, including by: violating any law; infringing others’ rights; storing content you have no right to store; attempting to disrupt or reverse engineer the service; or using the app to harm others.

6. Service changes

We may update, suspend, or discontinue features at any time. Cloud sync depends on third-party infrastructure (Google Firebase) and may be unavailable from time to time. The app remains usable offline with local storage.

7. Disclaimer

Marten is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or that data will never be lost.

8. Limitation of liability

To the maximum extent permitted by law, KodeFoundry will not be liable for any indirect, incidental, special, or consequential damages, or for any loss of data, profits, or secrets, arising from your use of Marten.

9. Termination

You may stop using Marten and delete your account at any time. We may suspend or terminate access if you violate these Terms.

10. Changes to these Terms

We may revise these Terms. Material changes will be reflected by updating the date above. Continued use after changes constitutes acceptance.
